During the time of the Imams (a.s)

the Shi'ah Muslim scholars of Fiqh were more active in collecting of the Ahadith. The Ahadith were once compiled in four hundred works and later on collected in the famous four major collections, namely al-Kafi, Kitab Man la yahdarhu al-faqih, Tahdhib al-'ahkam and al-'Istibsar.

Fiqh in its terminological sense commenced in the Shi'ah Muslim Madhhab from the time of the occultation of the Twelfth Imam (a.s) and the compilation of al-Tadhkirah bi usul al-Fiqh was the first momentous step by al-Shaykh al-Mufid in the second half of the fourth century of Hijrah. There were other scholars of Fiqh earlier than al-Shaykh al-Mufid. Among them were Ibn Abi 'Aqil, the author of al-Mustamsik bil Habl Al al-Rasul, and Muhammad Ibn Junayd, known as al-'Iskafi, the author of al-Nusrah li al-Ahkam al-'itrah. They endeavored to compile Fiqh in accordance with the approach of the Imams (a.s) but al-Shaykh al-Mufid and later on al-Sayyid al-Murtada widely became popular because of their formulating the issues of Fiqh on the basis of codified principles of the science of usul al-Fiqh. This method was further rectified and crystallized during the time of Shaykh al-Tusi. Some of the scholars who have noted down that the Shi'ah Muslim scholars of Fiqh did have a lead over their Sunni counterparts in the compilation of Fiqh. 'Allamah Sayyid Hasan al-sadr in his Ta'sis al-Shi'ah, 'Allamah Hajj Aqa Buzurg Tehran in his book al-Dhari'ah, Ustadh Mustafa 'Abd al-Razzaq in Tamhid li Ta'rikh al-Falsafat al-Islamiyyah and Doctor Nabhan in al-Madkhal li al-Tashri' al-'lslami have such notifications. It was due to their devoted effort in collecting and recording the sciences from the Imams (a.s). The following are considered to be of such works on Shi'ah Muslim Fiqh Sunan written by Abu Rafi', one of the companions of Imam Ali (a.s).

Although the Shi'ah Muslim school of Fiqh, for frequent reliance upon the sources going back to Imam Ja'far Ibn Muhammad al-Sadiq is known as the Ja'fari school of Fiqh. As a matter of fact Shi'ah Muslim Fiqh commenced at the time of the Prophet (s.a). The legal pronouncements of Imam Ali (a.s) were the first sparks of Shi'ah Muslim Fiqh, and the present form of the Shi'ah Muslim Fiqh is the development and extended form of those at that time.
